In a recent development, the Economic and Financial Crimes Commission (EFCC) has formally withdrawn its appeal against former Governor Bello, citing significant legal proceedings that have transpired since the initial filing. This decision underscores the evolving nature of the legal landscape surrounding the case.

The EFCC, in a notice dated April 22, announced its decision to withdraw the appeal, citing the emergence of events that have rendered the appeal moot. This withdrawal is in line with the intention of the appellant to fully retract their appeal against the respondent.

The decision to withdraw the appeal stems from a crucial legal development on April 17, 2024, when an application filed by the appellant was superseded by a ruling from the High Court of Kogi State. This ruling, delivered by Justice Jamil, pertained to the matter under appeal and effectively nullified the grounds for the appellant’s legal action.

Moreover, the orders issued ex parte by Jamil on February 9, 2024, were designed to remain in force until the resolution of the originating motion on notice. This motion, ultimately adjudicated upon by Justice Jamil on April 17, 2024, further solidified the legal basis for the withdrawal of the appeal.

Additionally, it is noted that the notice of appeal was filed beyond the stipulated time frame, further complicating the legal standing of the appellant’s case. As a result, the EFCC respectfully requests the dismissal of the appeal on the grounds of untimeliness and incompetence.

Meanwhile, the EFCC continues its prosecution of Bello on 19 counts related to allegations of money laundering, breach of trust, and misappropriation of funds totaling N80.2 billion. The case is currently under the jurisdiction of Justice Emeka Nwite at the Federal High Court in Abuja.

EFCC chief Ola Olukoyede has reaffirmed the commission’s commitment to prosecuting Bello, vowing to uphold accountability in the face of alleged financial impropriety. Notably, the commission has alleged that Bello withdrew $720,000 from state accounts to prepay his child’s school fees shortly before his departure from office on January 27, 2024.

The situation escalated recently when Bello was declared wanted by the EFCC after allegations surfaced that Governor Usman Ododo had facilitated his departure from Abuja, thwarting an attempted arrest by EFCC operatives at Bello’s residence.

The withdrawal of the appeal by the EFCC reflects the dynamic nature of legal proceedings and underscores the importance of adapting to evolving circumstances. As the case against former Governor Bello progresses, the EFCC remains steadfast in its pursuit of justice and accountability.
